LIABILITY WAIVER AND RELEASE

UPDATED RELEASE OF LIABILITY WAIVER

Before participating in any Pilates, Yoga, wellness activities, retreats, events, or personal training sessions (the “Activity”) offered by AMANARI WELLNESS & HOSPITALITY GROUP LLC (“AMANARI”), you acknowledge, understand, and agree to the following:

I have enrolled in a health, wellness, or fitness program offered through AMANARI. I understand that these programs may involve strenuous physical activity including, but not limited to, strength training, endurance training, cardiovascular conditioning, yoga, Pilates, mobility work, and other fitness or wellness activities. I acknowledge that these Activities may include both physical exertion and relaxation components.

I understand that certain classes or experiences may be conducted in heated environments, including the use of infrared heat. I acknowledge that such conditions may increase body temperature, heart rate, and physical exertion, and may pose additional risks including, but not limited to, dehydration, dizziness, nausea, heat exhaustion, and, in rare cases, heat stroke.

I understand that AMANARI does not provide medical advice, diagnosis, or treatment. All wellness activities, including yoga, Pilates, and related experiences, are not a substitute for professional medical guidance.

You should consult with a qualified healthcare provider before participating in any physical activity, especially if you have pre-existing health conditions.

I understand and agree that individuals who are pregnant should not participate in heated classes or any Activity that may pose a risk to their health or the health of their unborn child without prior medical approval.

I acknowledge that I am voluntarily participating in the Activities provided by AMANARI. I understand that participation may involve inherent risks, including the risk of physical injury, illness, or other adverse effects. I confirm that I am responsible for consulting with a qualified physician prior to participating in any Activity offered by AMANARI, including any fitness programs, wellness experiences, or nutrition-related guidance. I represent and warrant that I do not have any medical condition that would prevent my safe participation.

I assume full responsibility for any risks, injuries, damages, or losses, whether known or unknown, that I may incur as a result of my participation. I knowingly, voluntarily, and expressly waive any and all claims against AMANARI WELLNESS & HOSPITALITY GROUP LLC, including its owners, members, managers, employees, instructors, contractors, affiliates, partners, and representatives, for any injury, damage, or loss sustained as a result of participation, including those arising from negligence.

I acknowledge that participation in physical activity carries inherent risks, including but not limited to serious injury, disability, or death. I agree to listen to my body, discontinue any activity if I experience pain or discomfort, and seek guidance if needed. I understand that all participation is optional and that I may modify or decline any activity.

I understand that instructors and facilitators are not medical professionals and that the Activities offered are not a substitute for professional medical advice, diagnosis, or treatment. I agree to inform instructors of any medical conditions, injuries, pregnancy, post-natal status, or physical limitations prior to participation. I acknowledge that AMANARI is not responsible for any worsening of any condition.

I acknowledge that I am not taking any medication or undergoing any treatment that would impair my ability to safely participate in the Activities.

I ASSUME FULL RESPONSIBILITY FOR MY HEALTH, WELLBEING, AND PARTICIPATION IN ALL ACTIVITIES. I UNDERSTAND THAT PARTICIPATION IS AT MY OWN RISK. I HEREBY IRREVOCABLY RELEASE, WAIVE, AND DISCHARGE ANY AND ALL CLAIMS AGAINST AMANARI WELLNESS & HOSPITALITY GROUP LLC AND ITS AFFILIATES, ARISING FROM MY PARTICIPATION, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event that I require medical treatment, I agree to be financially responsible for any costs incurred. I understand that I am responsible for maintaining my own health insurance coverage.

I agree to indemnify, defend, and hold harmless AMANARI WELLNESS & HOSPITALITY GROUP LLC and its affiliates from and against any and all claims, liabilities, damages, costs, or expenses, including attorney’s fees, arising from my participation in the Activities or my actions.

I acknowledge that AMANARI is not responsible for the safekeeping of my personal belongings, and I assume full responsibility for any personal items brought to any Activity.

I agree to always conduct myself respectfully. Any inappropriate, abusive, or disruptive behavior may result in immediate removal from the Activity without refund.

I agree to be responsible for any damage caused to equipment, facilities, or property as a result of my actions, negligence, or misconduct.

COVID-19 Acknowledgment

I acknowledge that participation in Activities may involve exposure to COVID-19 or other communicable illnesses. I agree that I will not attend any Activity if I am experiencing symptoms or have reason to believe I may be contagious. I agree to follow all applicable health and safety guidelines.

Limitation of Liability

To the fullest extent permitted by law, AMANARI disclaims any liability for any loss, injury, or damage resulting from the use of our Services or reliance on any information provided.

I acknowledge that I have carefully read and fully understood this Waiver and Release of Liability. 

I understand that this is a legally binding document and that I am giving up substantial rights, including the right to sue.

 I sign this agreement voluntarily and of my own free will by engaging with our Services, you acknowledge that you are responsible for your own health, safety, and well-being. You agree to participate voluntarily and assume all associated risks.

 

I represent that I am at least 18 years of age, or that I have obtained appropriate parental or guardian consent.

Our Services may include links or references to third-party websites, products, or services. We do not endorse or assume responsibility for any third-party content or practices.
